General Terms and Conditions (GTC)

1.1 Scope of Application

These General Terms and Conditions apply to all orders placed via our online shop by both consumers and entrepreneurs.

  • For Germany: A consumer according to § 13 BGB is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

  • For Austria: The term "consumer" corresponds to the definition in the Consumer Protection Act (KSchG).

  • For Switzerland: "Consumer" refers to the definition under Swiss law.

  • For Entrepreneurs: If entrepreneurs use their own or supplementary terms and conditions, their validity is explicitly rejected. They shall only become part of the contract if we have expressly agreed to their inclusion.

1.2 Contracting Party, Conclusion of Contract, and Corrections

The purchase contract is concluded with Prodi GmbH. By displaying our products in the online shop, we submit a binding offer to conclude a purchase contract for the items shown. You may initially place products in the shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is formed as soon as you accept the offer by clicking the order button for the products contained in the shopping basket. You will receive a confirmation via email immediately after your order.

1.3 Contract Language and Storage of Text

The languages available for the conclusion of the contract are German and English. The contract text will be stored by us. After completing your order, you will receive the order data and our GTC in text form via email. For security reasons, the contract text is no longer accessible via the internet thereafter.

1.4 Delivery Conditions

Shipping costs are added to the stated product prices. The exact amount of shipping costs is transparently displayed within the respective product offers. Due to unforeseen circumstances, delivery delays may occur. Small and medium-sized parcels are delivered directly to your doorstep by DHL. For larger items or bulk orders, delivery is made to the curbside on a specialized wooden pallet. This pallet is part of the delivery and remains with the customer. Local pickup is not possible. Shipping is handled exclusively via a professional delivery service.

1.5 Payment Methods

The following payment options are generally available in our shop:

  • Bank Transfer (Prepayment): You will receive our bank details in a separate email. Goods are dispatched after payment is received.

  • Credit Card: Your card is charged immediately upon completion of the order.

  • PayPal / PayPal Credit Card / PayPal Direct Debit: Processed via PayPal (Europe) S.à r.l. et Cie, S.C.A.

  • Invoice via PayPal: Subject to a successful credit check by PayPal.

  • Sofort by Klarna: Direct bank transfer via Sofort GmbH.

  • Google Pay / Apple Pay: Fast checkout via your respective mobile wallet account.

  • Invoice (Direct): Payable within 7 days after receipt of goods and invoice. Subject to a successful credit check.

1.6 Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal as stated in the cancellation policy. Entrepreneurs are not granted a voluntary right of withdrawal.

1.7 Retention of Title

The delivered goods remain our property until full payment has been made. For customers based in Switzerland, we reserve the right to make a corresponding entry in the registry of retention of title.

1.8 Damage in Transit

  • For Consumers: If goods are delivered with obvious transport damage, please complain to the delivery agent immediately and contact us. Failure to do so does not affect your statutory rights but helps us assert our claims against the carrier.

  • For Entrepreneurs: The risk of accidental loss or deterioration passes to the entrepreneur as soon as the goods have been handed over to the forwarding agent or carrier.

1.9 Warranty and Guarantees

Statutory warranty rights apply. For entrepreneurs, the warranty period for newly manufactured goods is limited to one year from the transfer of risk. For Swiss consumers, the duty to inspect and notify defects immediately upon receipt applies. Customer Service: Available Mon–Fri (8:30–17:00) and Sat (9:00–12:00) at info@prodi-brutgeraete.de.

1.10 Liability

We are liable without limitation for damages caused by us, our legal representatives, or agents in cases of injury to life, body, or health, or intent/gross negligence. Our products are intended for their specified use only. The customer is responsible for proper use in compliance with animal welfare laws.

1.11 Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr. We are prepared to participate in dispute resolution proceedings before a recognized consumer arbitration board.

1.13 Final Provisions

For entrepreneurs, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a merchant, the exclusive place of jurisdiction is our registered office.
